JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner is before this Court calling in question the registration of a crime in Crime No.121/2024, pending before the 1st Addl. Senior Civil Judge & JMFC Court, Chitradurga District, for the offences under Sections 498A, 323, 307, 504, 506 read with Section 34 of Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. 2. Heard Sri. Prajwal Swamy M., learned counsel appearing for the petitioner, Smt. Rashmi Patel, learned HCGP appearing for respondent No.1, Smt. M. Sharmila Yadav, learned counsel appearing for respondent No.2 and have perused the material on record. 3. During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and respondent No.2 has filed the affidavit in that regard, which reads as follows: - 3 - HC-KAR NC: 2026:KHC:32755 CRL.P No. 4275 of 2025 “AFFIDAVIT I, C. Sowndarya, W/o Sri. Vishnu Gupta R.V, D/o Sri. M.R. Chandan, Aged about 26 years, R/at Nanjundeshwara Nilaya, V.P. Extension 1st cross, RTO Office Road, Chitradurga, today at Bangalore, do hereby solemnly affirm and state on oath as follows: 1. I state that I am the complainant/respondent No.2 in the above case, I known the facts and circumstances of the case, hence I am swearing to this affidavit. 2. I state that, the petitioner is my ex-husband I have solemnized the marriage with the petitioner on 21-08-2022, after the lapse of few days some difference arises among us, that being I have left the petitioners House on 2nd week of December, 2022, thereafter on 17-10-2024. I have lodged the complaint against the petitioner under section 498(A), 323, 307, 504, 506 R/w 34 of IPC, 3 and 4 of DP Act and filed the FIR in Cr No.0121/2024. 3. I further state that subsequently the petitioner filed the MC petition vide MC No.2346/2026 before the Principle Family Judge at Bangalore and subsequently the matter has been came to the Meditation, then the matter has been settled and got the divorce by Mutual consent dated 27-06-2026. 4. I further state that in the mean time the petitioner filed the above petition for quashing the FIR No. 0121/2024, as such as per the mutual consent we have settled the matter, I have no objection allow the petition to quash the FIR No. 0121/2024, hence this Petition. Wherefore, I most respectfully prays that this Hon'ble court be pleased to Quash the FIR No. 0121/2024 filed by me before the CHITRADURGA WOMEN P.S in the above case in the interest of render justice.” - 4 - HC-KAR NC: 2026:KHC:32755 CRL.P No. 4275 of 2025 4. In the light of affidavit of respondent No.2 being filed and offences not being against the State, I deem it appropriate to accept the affidavit of respondent No.2 and terminate the proceedings against the petitioner in the subject petition. 6. For the aforesaid reasons, the following: ORDER [I] Criminal Petition is disposed. [II] Proceedings in Crime No.121/2024 pending before the 1st Addl.
