Accused no.1 in Crime No.113 of 2026 registered by Pavagada Police Station, Tumakuru District for offences punishable under Sections 109, 115(2), 118(1), 190, 189(2), 351(2), 352, 74, 191(2), 191(3) of BNS 2023 is therefore this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.113 of 2026 was registered by Pavagada Police Station, Tumakuru District for the aforesaid offences against petitioner and others, based on the first information dated 15.04.2026 received from Smt. Nagamani, wife of Bandeppa. In the said case, petitioner herein was arrested on 15.04.2026 and subsequently remanded to judicial custody. Bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.5143 of 2026 was rejected on 04.05.2026. Perusal of the material on record would go to show that, the family of the accused and the family of the injured victims in the present case have certain civil dispute and it is in this background on 15.04.2026, they had fought against each other. In respect of the alleged incident that had taken place on 15.04.2026, there is a case and counter case registered by the very same police station in Crime No.113 of 2026 and Crime No.114 of 2026. 5. Injured victims in both the cases have suffered simple injuries and in both the cases, some of the accused persons have been arrested. It is not in dispute that petitioner who is an agriculturalist has no other criminal antecedents. Major portion of the investigation is completed. Under the circumstances, the following:- ORDER Criminal petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.113 of 2026 registered by Pavagada Police Station, Tumakuru for offences punishable under Sections 109, 115(2), - 4 - HC-KAR NC: 2026:KHC:33346 CRL.P No. 7078 of 2026 118(1), 190, 189(2), 351(2), 352, 74, 191(2), 191(3) of BNS 2023, subject to the following conditions:- a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
