This Writ Petition has been filed under Article 227 of the Constitution of India with the following prayers :- “(i) Issue a writ order or direction in the nature of mandamus directing the court of Learned Sub- Divisional Magistrate/Assistant Collector (First Class) Rudrapur, District Udham Singh Nagar to decide the Revenue Case No-22/31 Year 2016-2017 Under Section 176 of U.P Zamidari Abolition and Land Reform Act, 1950 “Gurbaj Singh vs. Jagdish Chand and Others” (Annexure No-1) Page No- to Page No- expeditiously preferably within a period of two months, otherwise the petitioner shall suffer irreparable loss and injury. 1 2026:UHC:2550 (ii) Issue any other or further order which this Hon'ble Court deems fit and proper under the facts and circumstances of the case. (iii) Award the cost of petition.” 2. Heard Mr. Mani Kumar, learned counsel for the petitioner, Mr. Ghanshyam Joshi, learned Additional Chief Standing Counsel for the respondent no.1 and Mrs. Anjali Bhargava, learned counsel for the respondent no.6. 3. The prayer no.1 has not been opposed by the respondent no.1 and the respondent no.6. 4. Having heard, the learned Sub-Divisional- Magistrate/ Assistant Collector, Ist Class, Rudrapur, District Udham Singh Nagar is directed to make an endeavour to expedite the proceedings of the Revenue Case No.22/31 of the year 2016-2017, “Gurbaj Singh vs. Jagdish Chand and Others”, filed under Section 176 of the Uttar Pradesh Zamindari Abolition and Land Reforms Act, 1950 (as applicable in the State of Uttarakhand), and decide the same as expeditiously as possible, as per law, but not later than three months from the date of production of certified copy of this order. 5. The present Writ Petition No.897 of 2026 (M/S) is disposed of accordingly. 2 2026:UHC:2550 6.
