Accused no.2 in Crime No.114 of 2026 registered by Pavagada Police Station, Tumakuru District, for offences punishable under Sections 109, 115(2), 190, 189(2), 133, 118(1), 351(2), 352, 74, 191(2) of BNS, 2023 is before this Court in this petition filed under Section 483 of BNSS, 2023. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.114 of 2026 was registered by Pavagada Police Station, Tumakuru District for the aforesaid offences against Chiga Chittappa and others, based on the first information dated 15.04.2026, received from Sri Thimmanna son of Kariyappa. In the said case, petitioner, who is arraigned as accused no.2 was arrested on 15.04.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.5150 of 2026 was rejected on 04.05.2026. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that, accused and the family of the injured victims in the present case have a civil dispute between themselves and it is in this background they had fought against each other on - 3 - HC-KAR NC: 2026:KHC:33354 CRL.P No. 7119 of 2026 15.04.2026. In respect of the alleged incident that had taken place on 15.04.2026, there is a case and counter case registered by the very same police station in Crime No.113 of 2026 and Crime No.114 of 2026. 5. It appears that both the parties have suffered only simple injuries in the incident in question and some of the accused in both the cases have been arrested and remanded to judicial custody. Petitioner who is an agriculturalist is said to have no other criminal antecedents. Under the circumstances, the following:- ORDER Criminal petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.114 of 2026 registered by Pavaga;da Police Station, Tumakuru District, for offences punishable under Sections 109, 115(2), 190, 189(2), 133, 118(1), 351(2), 352, 74, 191(2) of BNS, 2023, subject to the following conditions:- a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; - 4 - HC-KAR NC: 2026:KHC:33354 CRL.P No. 7119 of 2026 b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
