JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioners are before the Court seeking the following prayers: "a. Allow the present criminal petition; b. Direct the learned Metropolitan Magistrate Traffic Court-I, Mayo Hall Unit, Benglauru, to expedite the hearing and dispose of Crl.Misc.No.90/2020 within a time frame to be - 3 - HC-KAR NC: 2026:KHC:32588 CRL.P No. 9041 of 2026 fixed by this Hon'ble Court vide Annexure - C. c. Direct the Trial Court to regulate adjournments strictly and proceed with the matter. d. Grant such other reliefs as this Hon'ble Court deems fit in the facts and circumstances of the case, in the interest of justice and equity." 2. Heard Smt. Poornima H.S., learned counsel appearing for the petitioners and have perused the material available on record. 3. The petitioners are the respondents before the concerned Court in Crl.Misc.No.90/2020 invoked by the wife under Provisions of Domestic Violence Act, 2005. While the statute mandates expeditious closure of the proceedings, the proceedings are said to be pending for the last 6 years, without it moving forward and the perusal at the order sheet would clearly indicate adjournments being granted for the asking. 4. This Court is repeatedly coming across cases being filed for speedy disposal and in all those cases, the order sheets would indicate indiscriminate adjournments being granted contrary to the mandate of the statute, in this case particular. - 4 - HC-KAR NC: 2026:KHC:32588 CRL.P No. 9041 of 2026 As this Court would always observe that it is these indiscriminate adjournments that are clogging the Criminal Courts with pocket explosion. Therefore, the concerned Court shall now endeavour to conclude the proceedings in terms of the mandate of the statute, at any rate, within six months from the date of the receipt of the copy of this order, in accordance with law. 5. It is needless to observe that the parties to the lis would cooperate for disposal of the case, as is directed, failing which, it would be open to the concerned Court to pass necessary orders, in accordance with law. 6.
