LEGAL AID 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION NO: 8980/2023 ORDER: This Criminal Petition, under Section 483(3) of the BNSS, has been filed by the Petitioner herein, seeking cancellation of the bail granted to the Respondent/Accused vide Order dated 04.10.2023, in Crl.M.P.No.423 of 2023 in Crime No. 210 of 2023 of Dhone Town Police Station, passed by the learned I Additional Sessions Judge, Kurnool. 2. Heard Mrs.K.Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State and Sri Varun Byreddy, learned Legal Aid Counsel appearing for the Respondent/Accused. 3. Learned Assistant Public Prosecutor would submit that the present petition is filed seeking cancellation of the bail granted to the Respondent/Accused. She would further submit that the charge sheet is filed in this matter on 29.11.2023. 4. The impugned Order dated 04.10.2023 would show that the Respondent/Accused was released on bail on the condition that he shall appear before the Station House Officer on every Monday and Friday between 10.00 AM and 12.00 noon, until the filing of the charge sheet. It is also submitted by the learned Assistant Public Prosecutor that the charge sheet was filed in this matter on 29.11.2023. However, nothing has been placed before this Court regarding the date of release of the Respondent/Accused 3 from jail or the date on which he committed any default in complying with the conditions of bail. In absence of any violation of the conditions imposed, no reasons exist for cancellation of the bail granted to the Respondent/Accused. 5. In that view of the matter, this Criminal Petition is dismissed. As a sequel thereto, the miscellaneous applications, if any, pending in this Criminal Petition shall stand closed. __________________________________________ DR.
