CORAM:
HON’BLE MR JUSTICE SHAHZAD AZEEM, JUDGE.
(ORDER) 14.08.2026
01.
Heard learned Counsel appearing on behalf of the Petitioners.
02.
The Petitioners have called in question the charge-sheet arising out of FIR No. 12/2025 registered by Police Station Pethkoot, Bandipora under Sections 85, 351 (2), 74 and 191 (2) of the Bharatiya Nyaya Sanhita, 2023 [BNS].
03.
The main plank of the argument of the Petitioners is that there is no material showing prima facie complicity of the Petitioners in the commission of the alleged offences.
04.
It is not in dispute that the proceedings are at the stage of hearing on charge/ discharge and all these pleas urged by the Petitioners in this Petition are available to the Petitioners before the Trial Court. Therefore, this Petition is disposed of at this stage by providing that the learned Trial Court shall expedite the proceedings with regard to hearing on charge/ discharge and pass orders thereon expeditiously.
05.
Disposed of, along with the connected CrlM.
