Learned counsel for the petitioner submits that the petitioner is in custody since 15.07.2025 in connection with Hiranpur P.S. Case No.72/2025, registered under Sections 96, 69, 64(1), 70(2), 115(2), 351 (2), 103 (1), 238, 3(5) of B.N.S. and U/s 4, 6, 17 of POCSO Act, 2012, subsequently charge has been framed under Section 103 (1), 69 of BNS 2023 and u/s 4(2) of POCSO Act, now pending in the court of learned Sessions Judge – cum – Spl. Judge, POCSO, Pakur. 3. The learned counsel for the petitioner submits that it has come in paragraph 80 of the case diary that the petitioner had performed love marriage with the victim and the body was recovered from the jungle and he has been falsely implicated in this case. 4. The learned counsel for the State has opposed the prayer and submitted that the victim is a minor 17 years of age and she was subjected to gang rape also. 5. Considering the fact that the petitioner is named accused in this case with direct allegation and the victim is a minor, this Court is not inclined to enlarge the petitioner on bail. 2026:JHHC:9132 2 6.
