Ms. Sreyashee Biswas Ms. Baishakhi Chatterjee …for the State Learned advocate appearing for the petitioner submits that the petitioner is in custody for 7 years 9 months and till date only 10 witnesses have been examined and the prosecution intends to examine 21 more witnesses. Records of the case reflect that over issue of dispute relating to cutting of bamboo allegedly the accused fired at the lady which resulted in succumbing to the injuries. There are other overt acts which have been attributed to the accused. I find that the act of the accused which has been complained of and has surfaced in evidence is beyond normal human character. There is delay definitely but an offence cannot be isolated only on the point of the trial not concluding. In spite of earlier directions, I direct the learned trial court to substantially 2 progress with the trial of the case within a period of six months from date. At this stage, the prayer for bail of the petitioner in CRM(M)188 of 2026 is rejected. Learned Registrar General, High Court, Calcutta will communicate this order to the ADG, CID, West Bengal who would monitor the progress of the case and will send subsequent reports if the accused prefers bail before this Court. Learned trial court is also directed to adhere to the directions passed. Report submitted by the State be kept with the record. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
