Hon'ble Shri Justice Ravindra Kumar Agrawal Order on Board 09/07/2026 1. All these three regular bail application are the first bail application of the applicants under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023. The applicants- Ayush Jain (MCRC No. 5631/2026) and Naman Jaggi (MCRC No. 5547/2026) have been arrested on 05.05.2026 and the applicant- Ankit Agrawal (MCRC No. 5403/2026) has been arrested on 08.05.2026. All these applicants have been arrested in connection with Crime No. 202/2026, registered at Police Station Telibandha, District Raipur (C.G.), for the offence under Section 4(a) of Public Gambling Act, 1867, Section 7 of Chhattisgarh Gambling (Prohibition) Act, 2022 and Section 112 of Bharatiya Nyaya Sanhita, 2023 (in short ‘BNS'). 2. The case of prosecution is that, on 05.05.2026, the police of police station Telibandha received a secret information that the applicant 3 Naman Jaggi is engaged in selling ID of Gold777 online betting app near 36 Mall Telibandha and engaged in online gambling through his mobile phone. The police conducted raid there and found the applicant Naman Jaggi there, who was in his car No. CG 04 QX 3300 and two mobile phones have been seized from him. On being interrogation, he disclosed that he is having betting app of Gold777 and its ID i.e. Nald and password Hum12345. He also disclosed that he engaged in selling ID since two years and earning 50% commission. He purchased the said ID from Mohsil for Rs. 3 lakhs and he also disclosed his mobile number as 7456871342. He also disclosed the mobile numbers of Surfaraz @ Saif (6260386719) and Golu (8602490939), to whom he given the said ID. He further disclosed that he purchased betting app of Silverbet777, ID No. s201jaggi6660 having its face ID password from Sourabh Jain (9770948587) one month back on 50% commission for Rs. 3 lakhs. He also disclosed that he also purchased the betting app of jmdbet777.com having ID of sairam010 and password of Aabb1122 from Ayush Jain on 50% commission for Rs. 10 lakhs. Rs. 6000/- cash was also seized from Naman Jaggi. On the spot, Ayush Jain and Surfaraj @ Saif were also apprehended in their Thar vehicle No. CG 04 NU 0313 and two mobile phones from Ayush Jain were seized. From the mobile phone of Ayush Jain, the details of online gambling connection from Bb Gau (Babu Gauli) (7400763004) with betting app allpenalexch9.com with 15% commission and the saved phone number of 7387811111 of Bb NGP were extracted. He also disclosed the name of Sagar Adwani, Jayesh Bhaiya, Chanan, Golu Almas and Amit and also disclosed their mobile number, from whom 4 the betting app of Diamond book, but he presently deleted it. He also disclosed that he gave one master ID to Raj Gupta of Bhilai for running the online gambling at Hyderabad/Bangalore, which is connected with mobile No. 9243690376. Apart from this, some other persons have also operating the online gambling from Goa through mobile No. 8817096567, Mumbai and Kolkata, mobile No. 7828086215. ******* The accused Surfaraj @ Saif disclosed that he purchased the betting app and ID from Naman Jaggi and engaged in playing online gambling in cricket matches along with Ayush Jain. FIR has been registered during investigation. Total 14 accused persons were arrested who were found engaged in the syndicate of online gambling from different places, their mobile phone, cash amount and other articles have been seized and after completion of investigation against arrested accused persons, charge sheet has been filed. 3. Mr. Sunil Otwani, Senior Advocate appearing for the applicants- Ankit Agrawal and Ayush Jain (MCRC Nos. 5403/2026 and 5631/2026) would submit that there is no direct evidence against the applicants in the case regarding their involvement, either in conspiracy with other accused persons or engaged in playing online gambling. There is no incriminating material recovered from the mobile phones of the present applicants. Except for the memorandum statement, nothing substantive evidence is available in the charge sheet against the applicants. The place of incident is said to be the 36 Mall, whereas at the relevant point of time i.e. 05.05.2026, at about 13:16 hrs, the applicants were in their shop and the police arrested them from their shop. He would refer to the photographs annexed in the bail 5 application from page 164 to 179. In the notice to the witnesses under Section 179 of BNSS, 2023, they disclosed about secret information only against Naman Jaggi near 36 Mall and the betting app of Gold777. The memorandum statement of applicant Naman Jaggi was recorded on 05.05.2026, at 22:00 hrs. From the statement of the witnesses Baldev Soni and Mukesh Kodwani, to whom the notice was issued, it reflects that the memorandum statement of Naman Jaggi was recorded on the spot, whereas the memorandum statement of Naman Jaggi shows that it was recorded at Telibandha police station. Further, from the screenshot allegedly taken from the mobile phone, the betting app of God777 was extracted and not Gold777. Even there is no mention of any mobile number in the screenshot, from which mobile it was extracted. He would further submit that only the mobile phone of accused Naman Jaggi has been sent for its analysis, which itself creates doubt about involvement of the applicants in the offence in question. There is no bank account detail extracted from the mobile of the applicant and there is no money transaction from their mobile phones. Except from electronic evidence of the mobile phone, no other incriminating material available in the charge sheet against the applicant, which implicate the present applicants with the offence in question that the accused persons formed a syndicate and engaged in playing online gambling. 4. The electronic evidences are very weak type of evidence and there is no possibility of ultimate conviction of the accused persons on that basis. He would further submit that the investigation has been completed and charge sheet has been filed and no custodial interrogation is required. There is no criminal antecedent against the 6 applicants. The applicants Ankit Agrawal is in jail since 08.05.2026 and the applicant Ayush Jain is in jail since 05.05.2026. Final adjudication of the case will take its own time, therefore, they may be enlarged on regular bail. He would relied upon the order dated 05.01.2026, passed by the Hon’ble Supreme Court in Criminal Appeal No. 46/2026 (Dhruvil Patel v. State of Chhattisgarh), order dated 09.02.2026, passed in SLP (Crl) No. 1255 of 2026 (Ritik Mandilwar @ Bamfod v. State of Chhattisgarh), order dated 26.05.2026, passed in SLP (Crl) No. 8559 of 2026 (Sachin Jain v. State of Chhattisgarh) and order dated 16.02.2026, passed in SLP (Crl) No. 1839 of 2026 (Divy Chandrawanshi v. State of Chhattisgarh) and would submit that in the similar cases, the Hon’ble Supreme Court has granted bail to the accused persons. 5. Mr. Qamrul Aziz, learned counsel appearing for the applicant Naman Jaggi would submit that, from the photographs (annexure A/2) annexed with the bail application, it prima facie reveals that the applicant Naman Jaggi was not found on the spot, but he was arrested by the police from the TDS Pub Magneto Mall, Raipur on 04.05.2026. The police has deliberated suppressed the chain of events, which they conducted and has falsely implicated the applicant in the alleged offence of online gambling. The police called the vehicle of the applicant to 36 Mall and made seizure of the same. He would also submit that against the false implication of the applicant, his father has made a complaint on 07.05.2026 to the Police Commissioner, Raipur for proper investigation in the matter, so that there should be no any false implication of his son Naman Jaggi. From the mobile phone of the applicant, nothing incriminating data 7 could be recovered by the police and even there is no any certificate under Section 65-B of Indian Evidence Act that the screenshot allegedly taken out from the mobile phone is correctly taken out from the mobile phone of the applicant Naman Jaggi. There is no mobile number shown in the screenshot, from which mobile it was taken out. He would also submit that there is no criminal antecedent against the applicant, he is in jail since 05.05.2026, charge sheet has been filed, final adjudication will take its own time, therefore, he may be enlarged on bail. 6. On the other hand, learned counsel appearing for the State opposes the submissions made by learned counsel for the respective applicants and submitted that, there are sufficient and overwhelming material available in the charge sheet against the applicants. On being secret information, the applicant Naman Jaggi was apprehended near 36 Mall, Raipur and he disclosed the involvement of the present applicants and other accused persons, with whom he syndicate the online gambling and running the betting app on commission. From the mobile phone of Naman Jaggi, various incriminating data including the screenshots have been extracted with respect to running of betting app of online gambling. When the present applicants apprehended, they disclosed the chain of their syndicate and the manner in which they are using betting app through the ID provided by them. Their network and syndicate spread throughout various States of the country and a huge network they set for online gambling. From the screenshot s210jaggi6660 and Nald, Bb NGP of mobile number 7387811111, Bb Gau of mobile number 7400763004 various other details of betting app of God777, 8 allpenalexch9.co, etc. have been recovered. The present applicants have also disclosed about the running of betting app and their commission received from online gambling. He would also submit that the case diary reflected that against the applicant Ayush Jain, there is a criminal antecedent of crime No. 188/2019, registered at police station Aarang for the offence under Sections 3 and 13 of Public Gambling Act, 1867. Looking to their active involvement in the online gambling, their network throughout various States and the seriousness of the offence, the applicants are not entitled for bail. 7. With respect to the criminal antecedent of the applicant Ayush Jain, learned Senior Advocate would submit that, the person against whom, the said offence was registered is another person, as the address of the said person is different from the present applicants, although their fathers’ names are same. Even otherwise, that was the offence of the year 2019. 8. I have heard learned counsel for the respective parties and perused the case diary. 9. Considering the submissions advanced by learned counsel for the parties, the material collected during the investigation, and the allegations against the present applicants regarding their involvement in online gambling, as well as the recovery of incriminating material, this Court finds that the investigation prima facie reveals their involvement through the use of the Silverbet777 and jmdbet777 betting applications, along with various user IDs and passwords. The material further indicates that the applicants were in contact with the other accused persons through mobile phones for facilitating online 9 gambling. The screenshots forming part of the charge-sheet, the statements of witnesses Baldev Soni and Mukesh Kodwani, and the other materials collected during the investigation prima facie disclose the existence of a well-organized syndicate and an extensive network in which the applicants appear to have been actively involved. Online gambling constitutes an organized crime with multifarious ramifications and has a serious adverse impact on the economy of the country. Having regard to the gravity and nature of the offence, the manner in which the applicants are alleged to have participated in the commission of the offence, and the material available on record, this Court finds that the facts and allegations in the present case are distinguishable from those involved in the cases in which the Hon'ble Supreme Court granted bail to the respective accused persons. Therefore, no benefit can be extended to the present applicants on the basis of the orders relied upon by the learned counsel for the applicants. Accordingly, this Court is of the opinion that the applicants are not entitled to be released on bail. 10. Accordingly, the bail applications of present applicants- Ankit Agrawal (MCRC No. 5403/2026), Ayush Jain (MCRC No. 5631/2026) and Naman Jaggi (MCRC No. 5547/2026) are hereby rejected.
