This is a criminal revision filed by the petitioner with the allegations that inspite of the petitioner having prayed for release of sixteen buffalos seized by police in connection with Phansidewa Police Station dated 04.01.2026 under Section 317(5) of BNS 2023 along with Section 11 (1) (d) of the Prevention of Cruelty Against Animal Act, the Additional Chief Judicial Magistrate, Siliguri, in his order dated February 10, 2026 has not considered such prayer of the petitioner. Thus 2 the petitioner is aggrieved due to non consideration of his prayer for release all sixteen buffalos. 2. Ms. Ankana Rakshit, learned advocate appearing for the petitioner states that in spite of taking into notice the prayer of the petitioner as above in his order dated February 10, 2026, the Magistrate has not considered the prayer of the petitioner. For the said reason, the petitioner is prejudiced and aggrieved. She states that an order may be passed by this Court relating to sixteen buffalos in terms of prayer of the petitioner made before the learned Additional Chief Judicial Magistrate, Siliguri. 3. Considering the facts and circumstance, this Court finds service of his criminal revision application may not be imperative in this case. In stead the same may be disposed of with an appropriate direction. 4. Let this criminal revision be disposed of by directing the learned Additional Chief Judicial Magistrate, Siliguri, to consider and dispose of the petitioner’s prayer by dint of the put up petition dated February 10, 2026. Let it be done by the learned Additional Chief Judicial Magistrate, Siliguri in a time bound manner, positively within a period of two weeks. 5.
