Learned counsel for the petitioner submits that the petitioner is in custody since 02.01.2026 in connection with Bishnugarh P.S. Case No. 01 of 2026, registered under Sections 319(2), 318(4), 316(2) and 61(2) of the Bharatiya Nyaya Sanhita, 2023 and under sections 66C, 66D and 67 of I.T. Act, now pending in the court of learned J.M. 1st Class, Hazaribag. 3. Learned counsel for the petitioner further submits that the bail application of the petitioner was earlier rejected on 06.05.2026 in B.A. No. 2781 of 2026 and he has renewed the prayer for bail on the ground of custody since 02.01.2026 and also the fact that Sumit Kumar Verma, whose bail application was earlier rejected in B.A. No. 2749 of 2026 vide order dated 06.05.2026, has been subsequently enlarged on bail by this Court in B.A. No. 7916 of 2026 vide order dated 28.08.2026. 4. Learned counsel for the petitioner has further submitted that charge has been framed on 10.04.2026, but till date no witness has been examined. 5. Learned counsel for the opposite party- State, on the other hand, has opposed the prayer for bail and has submitted that the petitioner has one criminal case instituted against him also in Vijaypur, Karnataka as is recorded in order dated 06.05.2026 passed in B.A. No. 2026:JHHC:27256 2 2781 of 2026 wherein the petitioner had himself made this submission. She submits that there is no such criminal case so far as the other co-accused persons are concerned. 6. After hearing the learned counsels for the parties and considering the fact that the co-accused namely, Sumit Kumar Verma has been enlarged on bail on the ground that witnesses are not forthcoming for their examination, the case of the petitioner is similarly situated. Accordingly, the petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty-five thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Hazaribag in connection with Bishnugarh P.S. Case No. 01 of 2026, on the following conditions: (i) One of the bailors would be the present pairvikar of the petitioner. (ii) The other bailor should be his close relative. (iii) The petitioner will attend the court on each and every date and on account of even single default, the learned court shall cancel the bail bond furnished by the petitioner. (iv) The petitioner will deposit a self-attested copy of his Aadhar Card along with his mobile number before the learned court which he will not change during the pendency of the case without prior permission of the court. (v) The petitioner shall fully co-operate with the proceedings before the learned trial court. 7. The instant application is allowed with the aforesaid conditions. 8.
