The petitioners are apprehending their arrest in connection with Itkhori P.S. Case No. 79 of 2026, registered for the offence under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 333, 74, 303(2), 109, 352, 351(2) and 351(3) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Additional Chief Judicial Magistrate, Chatra. 3. Learned counsel appearing for the petitioners submits that the petitioners have been falsely implicated in the case and there are land dispute between the parties and both the sides are agnates. He submits that the nature of the injury is not known, however, it has come in the order of the learned Sessions Judge that surgical intervention is required for the injury. He further submits that the petitioners are having no criminal antecedent as disclosed in para 14 of the petition. 4. Learned counsel appearing for the State opposes the prayer and submits that the allegations are made of entering into the house and assaulting and in view of that prayer for anticipatory bail may kindly be rejected. 5. On perusal of the FIR, it transpires that there are general and omnibus allegation against all the petitioners of assault and the petitioners are having no criminal antecedent as disclosed in para 14 of the petition 2026:JHHC:27057 and it has been pointed out that there is land dispute and for that altercation took place, I am inclined to grant anticipatory bail to the petitioners. 6. Accordingly, the above-named petitioners are directed to surrender before the learned court within three weeks from today and in the event of their arrest or surrender, they shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Chatra, in connection with Itkhori P.S. Case No. 79 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Dated 09.09.2026 Anit Uploaded 11.09.2026
