Learned advocate for the petitioner submits that the petitioner is in custody for about one year seven months and till date charges have not been framed. There are other accused persons who have also been implicated in connection with the present case. Learned advocate also submits that till date the prosecution has not taken any step for proceeding with the case, although, they have relied upon eight witnesses. Learned advocate for the State oppose the prayer for bail and submits that the recovery in the present case is 1294 gm of Yaba Tablet. Having considered the quantum of seizure, I am of the view that the rigors of Section 37 of the NDPS Act is
2 attracted, as such, the prayer for bail of the present petitioner is rejected. Hence, the prayer for bail of the petitioner is Rejected. However, having considered the period of detention of the present petitioner, the learned trial court is directed to give priority to the evidence of the seizure list witnesses and complete their evidence within a period of three months from the date of communication of this order. The petitioner would be at liberty to renew his prayer for bail after the aforesaid time period is over. Accordingly, CRM (NDPS) 1099 of 2026 is dismissed. Memo of Evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
