Gaunjhu, A.P.P. ---- 02/Dated: 10th September, 2026 1. Heard learned counsel appearing for the petitioner as well as the learned counsel appearing for the State. 2. The petitioner is apprehending his arrest in connection with Sisai P.S. Case No.81 of 2026 for the alleged offences registered under Sections 115(2), 117(2) and 79 of Bharatiya Nyaya Sanhita, 2023, and under Sections 3/4 of Jharkhand Witchcraft Prevention Act, 2001, pending in the Court of learned S.D.J.M., Gumla. 3. Learned counsel appearing for the petitioner submits that the petitioner has falsely been implicated in this case. The incident is dated 05.07.2026 at about 7:15 p.m. whereas the FIR has been lodged on 12.07.2026. He submits that the fact remains that the informant side had assaulted the petitioner and his father and for that the petitioner has lodge a complaint case being Complaint Case No.713 of 2026 contained in Annexure-2 series. He submits that even the injury is said to be simple in nature. On these grounds, he submits that anticipatory bail may kindly be granted. 4. Learned counsel appearing for the State opposed the prayer and submits that allegation of assault is there and as such the prayer for anticipatory bail may kindly be rejected. 5. Considering that the said occurrence is dated 05.07.2026 at about 7:15 p.m. whereas the FIR has been lodged on 12.07.2026, the petitioner and his father have been assaulted and for that a complaint case being Complaint Case 2026:JHHC:27192 Page | 2 A.B.A. No.5051 of 2026 No.713 of 2026 contained in Annexure-2 series has been lodged, the injuries are said to be simple in nature, I am inclined to provide anticipatory bail to the petitioner. 6. Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., Gumla in connection with Sisai P.S. Case No.81 of 2026, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.)
