This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.241/2025 registered at Police Station Nagarnar, District Bastar (C.G.) for the offence punishable under Section 20(B) of NDPS, Act. Case of the prosecution, in brief, is that acting on secret information, the police intercepted a Santro car bearing registration No. UK-08-T-6189 and recovered 46.375 kilograms of ganja (commercial quantity) concealed beneath the rear seat and in a hidden chamber of the vehicle. During investigation, the co- accused allegedly disclosed that the contraband had been purchased from Odisha and was being transported at the instance of the present applicant. After completion of the investigation, the charge-sheet was filed against the applicant. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is submitted that no contraband was recovered from the possession of the applicant and his implication is based only on the memorandum statement of the co-accused. It is further submitted that the applicant had sold the Santro car bearing Registration No. UK-08-T-6189 on 24.08.2025, much prior to the alleged incident, and had handed over the vehicle along with its documents to the purchaser, who is the main accused. He would submit that the applicant has been in judicial custody since 26.02.2026, charge sheet has been filed and conclusion of trial will take some time, therefore, he prays for grant of bail to the applicant. 4. Learned State counsel opposes the bail application and submits that the applicant is the registered owner of the vehicle from which contraband article i.e. 46.375 kilograms of ganja was recovered which is above the commercial quantity.
Although the applicant
3 claims to have sold the vehicle, its ownership was never transferred in the official records. It is further submitted that the co-accused disclosed that the contraband was being transported at the instance of the applicant. Considering the commercial quantity of the seized ganja and the gravity of the offence under the NDPS Act, it is prayed that the bail application be rejected. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Considering the nature and gravity of the allegations, the recovery of 46.375 kilograms of ganja from the vehicle registered in the name of the applicant, which is above the commercial quantity and the material collected during investigation, including the memorandum of the co-accused, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail. 7. Accordingly, the bail application of the applicant Furkan Tyagi, involved in Crime No.241/2025 registered at Police Station Nagarnar, District Bastar (C.G.) for the offence punishable under Section 20(B) of NDPS, Act, is rejected. 8. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information. - Sd/-- Sd/-
