ORAL ORDER Petitioners – accused Nos.1 to 4 – husband and his family members are before this Court in these petitions, calling in question proceedings in C.C.No.75110/2025, pending before the XXIX Additional Chief Judicial Magistrate, Bengaluru, for offences punishable under Sections 85 r/w. 3(5) of the BNS and Section 4 of the Dowry Prohibition Act, 1961, in both the petitions. 2. Learned counsel for the petitioners – accused and respondent No.2 – complainant, in both the petitions, would submit that during the pendency of these proceedings, the parties to the lis have settled their matrimonial dispute amicably by drawing up certain terms and conditions. They have parted their ways and have filed a joint memo of compromise before this Court, seeking permission to compound the offences. 3. The joint memo of compromise reads as follows:

“1. The Petitioner is arraigned as Accused No. 1 in C.C. No.75110/2025 arising out of Crime No. 48/2025 registered by the Whitefield Women's Police Station, Bengaluru, for the offences punishable under Section 85 read with 3(5) of the Bharatiya Nyaya Sanhita (BNS) (equivalent to Section 498-A of the Indian Penal Code (IPC)] and Section 4 of the Dowry Prohibition Act, currently pending on the file of the XXIX Addl. Chief Judicial Magistrate, Bengaluru. 2. The present Criminal Petitions (Crl. P. No. 6159/2026 and Crl. P. No. 965/2026) have been filed by the Petitioner seeking to quash the said FIR and the subsequent charge sheet dated 15.09.2025. 3. It is respectfully submitted that during the pendency of the above proceedings, at the intervention of elders, family members, and well-wishers, the Petitioner and Respondent No. 2 have amicably resolved all their matrimonial disputes and misunderstandings. 4. The parties submit that their marriage solemnized on 06.12.2024 has already been dissolved by a decree of divorce granted by the Learned Principal Family Court, Bengaluru, vide order dated 04.03.2026. The said decree of divorce was granted based on a Memorandum of Settlement dated 04.03.2026 executed between the parties. 5. As per the express terms of the said Memorandum of Settlement, both parties have agreed to bring an end to all existing civil and criminal litigation between them.
Respondent No. 2 (Complainant) acknowledges that she has received all her agreed permanent alimony/settlement claims as per the mutual agreement, and she has no further claims whatsoever against the Petitioner (Accused No. 1) or his family members. 6. Respondent No. 2 hereby states that she has voluntarily withdrawn all allegations of mental, physical, and dowry harassment leveled against the Petitioner. She has no objection to this Hon'ble Court allowing the present Criminal Petitions and quashing the entire proceedings in C.C. No. 75110/2025 (Cr. No. 48/2025) pending before the XXIX Addl. C.J.M., Bengaluru, and the corresponding

FIRs challenged in Crl. P. No. 6159/2026 and Crl. P. No. 965/2026. 7. This Joint Memo is being filed voluntarily, out of the parties' own free will and volition, without any coercion, undue influence, or threat from anyone. “
In the light of the afore-quoted joint memo of compromise, I deem it appropriate to terminate the proceedings against the petitioners in both the petitions, as it is a matrimonial dispute and the allegations are not against the State. 4. For the aforesaid reasons, the following:
O R D E R (a) The criminal petitions are disposed. (b) The proceedings in C.C.No.75110/2025, pending before the XXIX Additional Chief Judicial Magistrate, Bengaluru, impugned in both the petitions, stand quashed. All pending I.A.s’ in both the petitions, if any, also stand
