The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No. 147/2026, registered at Police Station – Tilda Neora, District – Raipur (C.G.) for alleged commission of offence punishable under Section 20(B) of NDPS Act. 2. According to the prosecution's story, it was alleged that on 08.04.2026 the Police received information that two persons were involve in transportation of contraband Ganja in Motorcycle bearing registration No. C.G.04/DR/5280, kept in Green Suitcase and Maharun Beg, and on this information after compliance of mandatory provision of the Act, investigation officer proceeded RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI 2 and one motorcycle coming where two persons were sited and after seeing Police party one person skip from the Motorcycle, and the co-accused Guman Mandle was arrested on spot and 8.500 Kgs Ganja was seized from his possession, and the name of the applicant has come into light from the memorandum statement of the said co-accused. Hence, this application. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. He submits that the applicant is involved any transportation of the contraband article Ganja and he has not given any help to the co- accused Guman Mandle, and the applicant was not present at the time of transportation of Ganja, therefore, he prays for grant of anticipatory bail to the applicant. 4. On the other hand learned State counsel opposes the application for grant of anticipatory bail to the applicant, and submits that on 08.04.2026 the Police received information that two persons were involve in transportation of contraband Ganja in Motorcycle bearing registration No. C.G.04/DR/5280, kept in Green Suitcase and Maharun Beg, and on this information after compliance of mandatory provision of the Act, investigation officer proceeded and one motorcycle coming where two persons were sited and after seeing Police party one person skip from the Motorcycle, and the co-accused Guman Mandle was arrested on spot and 8.500 Kgs Ganja was seized from his possession, and the name of the applicant has come into light from the memorandum statement of 3 the said co-accused, which goes to show that the applicant is having involvement in the crime in question as equal as co- accused. Hence, the instant bail application is liable to be rejected. 5. Recently the Supreme Court in the matter of Anarul SK v. The State of West Bengal {SLP (Crl.) No(s). 12621/2024 has observed that the grant of anticipatory bail in cases involving Narcotic Drugs and Psychotropic Substances (NDPS) is a very serious issue. 6. In the light of observation made by the Supreme Court in Anarul SK (supra), and considering the fact that the applicant along with co-accused during the transportation of the contraband article, after seeing Police party one person/applicant jumped and ran away from the Motorcycle, and the co-accused Guman Mandle was arrested on spot and 8.500 Kgs Ganja was seized from his possession, and the name of the applicant has come into light from the memorandum statement of the said co-accused, which goes to show that the applicant is having involvement in the crime in question as equal as co-accused, I do not find any good ground to entertain this anticipatory bail application.
