A detailed order was passed in this writ petition on 29.09.2026 as under:-
“Notice. Ms. Menka Raj Chauhan, learned Deputy Advocate General, appears and waives service of notice on behalf of the respondents.
2.
Facts:- 2(i). The case set up is that the petitioner was initially appointed as Language Teacher on contract basis in the respondent-Education Department on
28.02.2011. Pursuant to the judgment dated 13.05.2024 rendered in CWPOA No.1453 of 2020 (Himachal Government Teachers Union and others Versus State of Himachal Pradesh and others), respondent No.3 vide office
order dated 30.08.2024, granted deemed regularization to the petitioner w.e.f. 28.02.2011, i.e. the date of her initial

Petitioner’s pay was fixed at Rs.10300-34800 with Grade Pay of Rs.3200/-. 2(ii). Petitioner preferred a representation on 01.02.2026 (Annexure P-7) seeking benefit of pay scale of Rs.10830/- with Grade Pay of Rs.3600/-. This prayer was made on the basis of decisions rendered in CWP No.3341 of 2019 (Madan Lal Sharma Versus State of Himachal Pradesh and another), decided on 04.09.2021 and CWP(T) No.5759/2008 (Subhash Chand and another Versus State of Himachal Pradesh and others), decided on 5.7.2010. 2(iii). CWP No.5147 of 2026 preferred by the petitioner was decided on 23.04.2026 with direction to the respondents to decide the aforesaid representation of the petitioner. Respondent No.3-the Deputy Director of School Education, Kangra at Dharamshala considered the case of the petitioner and passed office order on 12.06.2026, granting pay scale of Rs.10300-34800 with Grade Pay of Rs.3600/- w.e.f. 03.05.2016. 2(iv). Petitioner received the pay scale accordingly with Grade Pay of Rs.3600/-. Her grievance is to the corrigendum dated 11.09.2026 (Annexure P-13) issued by respondent No.3, whereby her Grade Pay has been reduced from Rs.3600/- to Rs.3200/-. 3. Petitioner's case is that the aforesaid reduction in the Grade Pay has been carried out only for Shastri and Language Teachers in District Kangra. Elsewhere in the State, similar teachers are enjoying the Grade Pay of Rs.3600/-. On merits also, petitioner has pleaded that the revised pay scale admissible to Shastri and Language Teachers w.e.f. 01.01.1986 was Rs.1640-2925/-, subsequently revised to Rs.5480-8925/- w.e.f.
01.01.1996. The revised pay scale of Rs.5480-8925/- corresponds to revised pay band of Rs.10300-34800 with Grade Pay of Rs.3600/-, as reflected in the general conversion table/fitment table No.11 (Annexure P-6). It is the case of the petitioner that despite having been granted deemed regularization w.e.f. 28.02.2011, she had been wrongly allowed Grade Pay of Rs.3200/- instead of Rs.3600/-. It is for this reason, she had preferred the representation, which was allowed under office order dated 12.06.2026, sanctioning Grade Pay of Rs.3600/-. Without there being any change, the respondents unilaterally without issuing any notice to her, withdrew the Grade Pay of Rs.3600/-. 4.
In view of above, learned Deputy Advocate General to have instructions from the respondents as to why after allowing the representation of the petitioner and sanctioning Grade Pay of Rs.3600/- in her favour and
3 releasing the said grade pay for about three months, the same has been withdrawn under the so-called corrigendum dated 11.09.2026. List on 30.09.2026.”
2. Pursuant to above order, learned Deputy Advocate General has placed on record copy of office order dated 28.09.2026 from the Deputy Director of School Education (Elementary), Kangra at Dharamshala, withdrawing the corrigendum dated 11.09.2026. Since the grievance of the petitioner has now been redressed, this writ petition to stand disposed of accordingly. Pending miscellaneous application(s), if any, also stand disposed of.
