Paonam, learned senior counsel assisted by Ms. Malemleima, learned counsel for the petitioner in WP(C) No. 110 of 2026; Mr. H. Debendra, learned Dy. A.G. assisted by Ms. Sanya Shangari, learned counsel for the State respondent; Mr. S. Biswajit, learned senior counsel assisted by Mr. H. Prabirkumar, learned counsel; Mr. N. Ibotombi, learned senior counsel assisted by Mr. Ningtamba, learned counsel; Mr. W. Jamon, learned counsel and Mr. M. Rendy, learned counsel for some of the private respondents. Mr. S. Biswajit, learned senior counsel also appears for the petitioner in WP(C) No. 854 of 2024. [2] In WP(C) No. 110 of 2026, the petitioners challenged the final seniority list of MCS Grade-II issued vide notification dated 04.02.2026 whereby the names of 87 (eighty seven) Officers are admitted in the final seniority list. It may be noted that the State respondent has earlier issued a tentative seniority list dated 07.01.2026 of MCS Grade-II containing 88 (eighty eight) Officers. [3] Vide order dated 11.03.2026 in this batch of writ petitions, this Court passed an interim order that any proceeding for promotion on the basis of impugned final seniority list dated 04.02.2026, result shall not be declared without leave of this Court. [4] Mr. H. Debendra, learned Dy. A.G., has already submitted that DPC was held on 15.04.2026. However, result could not be declared due to interim order dated 11.03.2026 passed by this Court in the batch of writ petitions. [5] Mr. N. Ibotombi, learned senior counsel appearing on behalf of three Officers in MC(WP(C) No. 237 of 2026 [Ref: WP(C) No. 110 of 2026] and MC(WP(C) No. 238 of 2026 [Ref: WP(C) No. 854 of 2024] and whose names are at serial Nos. 12, 13 & 21 of the final seniority list , prays that interim order dated 11.03.2026 may be modified to the effect that result of the DPC held on 15.04.2026 be declared for the applicants, as their seniority position are not disputed by the petitioners and respondents in the connected matters. [6] Other private respondents in WP(C) No. 110 of 2026 have also filed applications for vacating the interim orders. [7] Mr. S. Biswajit, learned senior counsel for the applicants in MC(WP(C) No. 182 of 2026 and Mr. M. Rendy, learned counsel for the applicants in MC(WP(C) No. 254 of 2026, submit that the main matters may be expedited for disposal on merit and State respondent may be directed to file counter affidavits in all the pending petitions and applications. [8] Mr. W. Jamon, learned counsel for the applicant in MC(WP(C) No. 179 of 2026, submits that the matter may be taken up on some other day due to personal inconvenience of the arguing counsel. [9] All the learned counsel appearing for the parties have not disputed seniority position of the incumbents from serial No. 1 to 38 in the final seniority list and as apparent from the case record, the dispute in the seniority position starts from serial No. 39 onwards and the dispute in the seniority list in WP(C) No. 110 of 2026 is from serial No. 39 to 62. [10] This Court has also perused the tentative seniority list dated 07.01.2026 and final seniority list dated 04.02.2026 and it is found that officers from serial No. 1 to 38 are common in both seniority list. In the circumstances, this Court is of the view that interim order dated 11.03.2026 may be modified to the extent that the result of the DPC proceeding held on 15.04.2026, may be declared for the officers, from serial No. 1 to 38 of the final seniority list dated 04.02.2026. The remaining applications for modification/vacating interim orders will be considered on the next date. Interim order dated 11.03.2026 is modified accordingly. [11] MC(WP(C) No. 237 of 2026 [Ref: WP(C) No. 110 of 2026] and MC(WP(C) No. 238 of 2026 [Ref: WP(C) No. 854 of 2024] are disposed of in terms of the above observation. [12] Both learned counsel for the petitioners and private respondents submit in one voice that due to pendency of the present writ petitions, the case of the petitioners and private respondents cannot be considered for promotion in the DPC conducted on 15.04.2026. In the circumstances, State respondents shall make an endeavour to file counter affidavit within a period of three weeks. In case of difficulty in filing counter affidavit, relevant file may be placed before this Court for assistance. [13] List this case on 20.05.2026.
