GOPALA KRISHNA RAO TRANSFER CIVIL MISCELLANEOUS PETITION No.56 of 2026 ORDER: The petitioner/wife herein filed the present petition under Section 24 of the Code of Civil Procedure, 1908 (for short, ‘the C.P.C.’), seeking to withdraw the suit in G.W.O.P.No.69 of 2025, on the file of learned XI Additional District Judge, Tadepalligudem and transfer the same to the file of Additional Family Court at Vijayawada, for trial and disposal. 2. When the matter was taken up for hearing today, both the learned counsel are present, and the learned counsel for the respondent submitted that they have no objection to transfer the G.W.O.P. No. 69 of 2025, which is now pending before the learned XI Additional District Judge, Tadepalligudem, to the learned Additional Family Court at Vijayawada, where F.C.O.P. No.1493 of 2025, filed by the respondent herein for restitution of conjugal rights, is pending. 3. Heard learned counsel appearing on both sides. 4. Perused the material available on record. 5. Considering the submissions made by the learned counsel for the petitioner as well as the respondent, and the averments in the affidavit filed by the petitioner, I am of the considered view that it is a fit case for transfer of G.W.O.P. No. 69 of 2025, from the file of the learned XI Additional District Judge, Tadepalligudem, to the file of Additional Family Court at Vijayawada. 6. In the result, the present Transfer Civil Miscellaneous Petition is allowed, and G.W.O.P. No. 69 of 2025, on the file of the learned XI Additional District Judge, Tadepalligudem, is withdrawn and transferred to the file of the Additional Family Court at Vijayawada. The learned XI Additional District Judge, Tadepalligudem, shall transmit the case record in G.W.O.P. No. 69 of 2025 to the Additional Family Court at Vijayawada as expeditiously as possible, preferably within a period of five days from the date of receipt of a copy of this order. Both parties are directed to appear before the Additional Family Court at Vijayawada, on 08.05.2026 at 10.30 A.M., in which Court F.C.O.P. No. 1493 of 2025 is pending. There shall be no order as to costs. As a sequel, miscellaneous petitions, if any pending and the Interim Order granted earlier, if any, shall stand closed. _______________________________ JUSTICE V.
