02/ 10.09.2026: Heard learned counsel for the petitioners and learned counsel for the State.
2. The petitioners are apprehending their arrest in connection with Chandwara P.S. Case No. 26 of 2026, registered under sections 126(2), 115(2), 109(1), 303(2), 352, 351(2), 3(5) of BNS, 2023, pending in the Court of learned Judicial Magistrate, Ist Class, Koderma.

Learned counsel for the petitioners submits that petitioners have been falsely implicated in this case. He next submits that informant is the sister-in-law of the petitioner no.1 and there are general and omnibus allegations against all the accused persons. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that there is direct allegation of assault against petitioner no.1 and pursuant to that grievous injury has been received by the informant that has come in the order of the learned Sessions Judge.

On perusal of F.I.R. it transpires that there is direct allegation of assault against the petitioner no.1 and pursuant to that grievous injury has been received by the informant that has come in the order of the learned Sessions Judge. In view of that I am not inclined to grant anticipatory bail to the petitioner no.1. Accordingly, the prayer of anticipatory bail on behalf of petitioner no.1 namely, Ajay Yadav, is hereby rejected.

So far prayer of anticipatory bail on behalf of petitioner no.2 is concerned, the petitioner no. 2 is a lady and wife of petitioner no.1 and there is general and omnibus allegation against her, I am inclined to grant anticipatory bail to the petitioner no.2. Accordingly, the petitioner no.2 namely, Anokha Devi is directed to surrender before the learned court

within three weeks from today and in the event of her surrender / arrest, the petitioner 2 shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, Ist Class, Koderma, in connection with Chandwara P.S. Case No. 26 of 2026, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
