Leaned Senior counsel appearing for the petitioner submits that the petitioner has earlier moved twice however the anticipatory bail of the petitioner has been dismissed. He next submits that on protest petition the cognizance has been taken and in view of that, there is no requirement of custodial interrogation and in that view of the matter, he seeks permission to withdraw the instant petition with liberty to move before the learned court by way of filing appropriate petition in light of the judgment of the Hon’ble Supreme Court rendered in the case of Om Prakash Chhawnika @ Om Prakash Chabnika @ Om Prakash Chawnika v. State of Jharkhand and Another. 3. Learned counsel appearing for respondent State has got no objection for same. 4. This petition is dismissed as withdrawn with aforesaid liberty.
