Form No. J(2) In the High Court at Calcutta Constitutional Writ Jurisdiction Appellate Side Present: The Hon’ble Justice Sabyasachi Bhattacharyya And The Hon’ble Justice Supratim Bhattacharya WPLRT 61 of 2026 Gayaram Manna Vs. The State of West Bengal and others For the petitioner : Mr. Sujit Kumar Rath Heard on : 29.06.2026 Judgment on : 29.06.2026 Sabyasachi Bhattacharyya, J.:- 1. Affidavit-of-service filed today be kept on record. Despite service, none appears for the State at the time of call. 2. The present challenge has been preferred against an order dated February 18, 2026 passed by the Fourth Bench of the West Bengal Land Reforms and Tenancy Tribunal. 3. Learned counsel for the petitioner points out that the application of the petitioner, seeking consideration of a representation given to the Block Land & Land Reforms Officer (B.L. & L.R.O), Contai-II, was dismissed by the impugned order on the ground that it was erroneously addressed to the B.L. & L.R.O, Contai-III. 2 4. Learned counsel places reliance on the annexures to the writ petition to indicate that although the representation, in its caption, was erroneously addressed to the B.L. & L.R.O, Contai-III, the representation was actually sent to the B.L. & L.R.O, Contai-II, which is evident from the postal track report. 5. Be that as it may, instead of entering into the merits of the controversy at this premature stage, it would only be appropriate that the petitioner, in order to obviate the unnecessary inconveniences involved, submits a fresh representation, correctly addressed to the B.L. & L.R.O, Contai-II. 6. In view of the innocuous nature of the proposed order, we are not directing further service of notice on the State. 7. WPLRT 61 of 2026 is accordingly disposed of without interfering with the impugned order but granting liberty to the petitioner to file a fresh representation on the self-same subject-matter as that involved in the present application, to the B.L. & L.R.O, Contai-II. 8. If such a representation is made, the B.L. & L.R.O, Contai-II shall decide the same independently, in accordance with law and on its own merits, by considering all the documents annexed thereto, upon giving an opportunity of hearing to the petitioner and all other interested persons, without being influenced in any manner by any of the observations made herein and/or the order impugned before us. 9. There will be no order as to costs. 3 10. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities. (Sabyasachi Bhattacharyya, J.) I agree. (Supratim Bhattacharya, J.) AD-65 TN
