No. 876/2022, dated 05.02.2022 , on the assurance of issuing TDRs as per Government Memo No. 1768902/HI/2024, dated 20.08.2024, as arbitrary, illegal, contrary to the provisions of the Municipal Corporation Act , and in violation of Article 300-A of the Constitution of India and the principles of natural justice and consequently direct the Respondents to issue the TDR bonds to the petitioner and pass IA NO: 1 OF 2025 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondents to consider and dispose of the Petitioner’s representations for issuance of TDR bonds, pursuant to Gift Deed Doc. The petitioner is aggrieved by the action of respondents in not issuing TDR bonds in lieu of taking over the petitioner’s land admeasuring 12,342 Square yards in Sy.Nos.226/6B, 226/7 and 266/10 in Tanuku Municipality for public purpose. 2. When the matter is taken up for hearing today, learned counsel for the petitioner submits that the issue involved in this writ petition is squarely covered by the order dated 30.10.2025 passed by this Court in W.P.No.539 of 2021 and requested to pass a similar order in this writ petition also. 3. Learned Standing Counsel for the 3rd respondent/Municipality conceded the same. 4. In view of the same, for the reasons alike in the aforesaid order, this writ petition is also disposed of directing the 3rd respondent/Tanuku Municipality to calculate the TDR Bond(s) eligibility of the petitioner for the land gifted by the petitioner and issue the TDR Bond(s) to the petitioner, within a period of eight (08) weeks from the date of receipt of this order. There shall be no order as to costs. 5. Registry is directed to annex a copy of the order in W.P.No.539 of 2021 to the order in the present writ petition.
