Order No.03 Dated-01-04-2026
Heard the parties.
The petitioner has been made accused in connection with Telco P.S. Case No. 127 of 2024 registered for the offence punishable under Sections 103, 3(5) of the B.N.S., 2023 and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner along with Mukesh Kumar has committed murder of Sunil Singh. It is next submitted that the allegation against the petitioner is false. It is then submitted that the petitioner has been in custody since 19.12.2024 as mentioned in para-1 of the instant bail application. It is then submitted that the co-accused, with similar allegations, has already been admitted to bail by this Court vide order dated 15.07.2025 passed in B.A. No. 5732 of 2025. It is further submitted that the petitioner is ready and willing to co- operate with the trial of the case. Hence, it is submitted that the petitioner be released on bail.
Learned counsel appearing for the State on the other hand opposes the prayer for bail of the petitioner and submits that the case of the co-accused who have been admitted to bail, stands on different footings as there is direct and specific allegation against the petitioner and Mukesh Kumar only of committing murder. It is next submitted
that keeping in view the serious nature of allegation against the petitioner, there is every chance of the petitioner absconding and tampering with the evidence, if released on bail. It is further submitted that the petitioner has made extra-judicial confession of having committed the murder of Sunil Singh. Hence, it is submitted that the petitioner ought not to be released on bail. Considering the serious nature of allegation against the petitioner as well as chance of his absconding and tampering with the evidence, if released on bail, this Court is not inclined to admit the bail of the above named petitioner to bail. Accordingly, the prayer for bail of the above named petitioner is rejected.
