B.A. No. 7823 of 2026 Shan Goyal @ Abhishek
… … Petitioner
Versus
The State of Jharkhand
… Opposite Party
------- CORAM : HON'BLE MR. JUSTICE RONGON MUKHOPADHYAY
-------
For the Petitioner : Mr. K.S. Nanda, Advocate
For the State
: A.P.P
------- 02/10.09.2026
Heard Mr. K.S. Nanda, learned counsel for the petitioner and learned A.P.P.
The prayer for bail of the petitioner was earlier rejected in B.A. No. 10921 of 2025.
Submission has been advanced by the learned counsel for the petitioner that para-40 of the case diary which was the basis for rejecting the prayer for bail of the petitioner does not indicate that the petitioner was armed with a Dabia when he had entered into the house of the deceased. It has further been submitted that five witnesses are still left to be examined and save and except suspicion, no material has come even in course of the trial to indicate about the complicity of the petitioner in committing the murder.
Learned A.P.P has opposed the prayer of the bail of the petitioner.
Though at para-40 there is no mention of the petitioner having a Dabia in his possession, but at the same time it appears that on several occasions the petitioner had entered into the house of the deceased and on the last occasion he had speedily left which creates a strong circumstance of the petitioner being involved in committing murder of the cousin sister of the informant. Moreover, as has been stated by learned counsel for the petitioner, out of 13 charge sheet witnesses, 8 witnesses have already been examined.
On consideration of the aforesaid facts, I am not inclined to grant bail to the petitioner and the same stands rejected once again.
This application stands rejected.
