JUSTICE RAVI V HOSMANI ORAL ORDER Seeking for quashing of entire proceedings in Crime no.56/2019 registered by Lashkar Police Station, Mysuru, presently stated to be pending in CC no.275/2020 on file of IV Additional Senior Civil Judge and JMFC, Mysuru for offences punishable under Sections 406, 420 read with Section 34 of Indian Penal Code, 1860 (IPC) insofar as petitioner-accused no.2 is concerned, this petition is filed. - 3 - HC-KAR NC: 2026:KHC:32688 CRL.P No. 603 of 2021 2. Learned HCGP for respondent no.1 - State has filed a memo stating that during pendency of petition, proceedings before trial Court have progressed and charges were framed on 24.01.2024 and trial had commenced, rendering above petition infructuous. 3. Learned counsel for respondents no.2 and 3 support submission of learned HCGP. 4. Sri Prajwal, learned counsel appearing for Sri Parashuram A.L., learned counsel for petitioner however submitted that framing of charges and commencement of trial would not automatically result in petition being rendered infructuous. In support of his submission, he relied upon order passed by Hon'ble Supreme Court in Ramdular Singh v. State of UP & Anr. (SPL.(Crl.) no.11919/2024 disposed on 02.12.2024). 5. Perusal of order sheet in this petition reveals that though matter was filed in year 2021 and listed on innumerable dates of hearing, there was no interim order. On 23.06.2026, learned HCGP had submitted that matter before trial Court had progressed and charges were framed. Hon'ble Supreme Court - 4 - HC-KAR NC: 2026:KHC:32688 CRL.P No. 603 of 2021 in case of Meenakshi Bala v. Sujath Kumar & Ors. reported in (1994) 4 SCC 142, has held a petition filed under Section 482 of CrPC at stage when charge sheet was filed would be rendered infructuous on framing of charges. Though in Ramdular Singh's case (supra), Hon'ble Supreme Court remitted matter back to High Court for consideration of challenge against charge sheet on merits, same is on account of matter having reserved for judgment before High Court and released without passing judgment after 14 months and charges having framed during said period. Same would not apply to facts and circumstances in this case. 6. Following ratio in Meenakshi Bala's case (supra), petition is dismissed as having become infructuous, however, reserving liberty to petitioner, to urge all contentions before trial Court at appropriate stage.
