JUSTICE P SREE SUDHA ORAL JUDGMENT Learned counsel appearing for the appellant has stated that she filed xerox copy of the DL and permit of the offending vehicle before the Tribunal, but it was not considered. As such she obtained certified copies from RTO of Chikkaballapura. Therefore, the said documents are received and matter is remanded back to the Tribunal with a specific direction to give reasonable opportunity to both sides for adducing evidence and for arguments and to dispose of the matter within two months. 2. Learned counsel appearing for respondent No.2 stated that, though owner of the vehicle appeared before the Tribunal, he has filed only written statement, he has not filed any document. Inspite of granting a reasonable opportunity, - 3 - HC-KAR NC: 2026:KHC:32301 MFA No. 6744 of 2013 this Court finds that the claimant is not entitled for any interest from the date of accident i.e., 14.05.2007 to 30.06.2026. Accordingly, I pass the following: ORDER i) The appeal is allowed and remanded; ii) The Tribunal is specifically directed to give reasonable opportunity to both sides for adducing evidence, arguments and to dispose of the matter on merits by duly considering the entire evidence on record within 2 months from the date of the order as it is a matter of 2013; iii) Both the counsels are directed to co-operate with the Tribunal for disposal of the case within the stipulated time; iv) Registry is directed to send back the entire records including IAs to the Trial Court within 10 days; v) Both the parties are directed to appear before the Tribunal on 20.07.2026; - 4 - HC-KAR NC: 2026:KHC:32301 MFA No. 6744 of 2013 vi) All contentions of the parties are kept open.
