This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 have been filed by the applicants, GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2026.07.09 11:23:39 +0530 2 who are apprehending their arrest in connection with Crime No.256/2026 registered at Police Station – Kharora, Distt. Raipur (C.G.) for the offence punishable under Section 420 IPC. 2. Prosecution's case originated from a private complaint filed under Section 156(3) of the Cr.P.C. by Smt. Uma Purena and Ramesh Kumar Purena before the Judicial Magistrate First Class (JMFC), Raipur. The complaint was directed against the public representatives and officials of Gram Panchayat Beldarsivni, specifically against the applicants. Further it alleged that the Sarpanch, Secretary, and Rojgar Sahayak had violated financial norms and were prima facie guilty of embezzling a total calculated sum of Rs. 2,01,441/-. 3. Learned counsel for the applicants submits that the applicants are innocent and have been falsely implicated due to political rivalry arising out of the Panchayat elections. It is submitted that the inquiry conducted by the competent authority found most of the allegations to be baseless, while the remaining discrepancies are merely administrative irregularities caused by technical and banking issues and do not disclose any criminal intent. It is further submitted that there is no allegation of personal gain or misappropriation by the applicants, and the entire case is based on official records which are already in the custody of the investigating agency. The applicants are permanent residents, Applicant No. 1 is an elected Sarpanch and Applicant No. 2 is a government servant, and there is no likelihood of their absconding or tampering with the evidence. They are ready to cooperate with the investigation and abide by all the conditions imposed by the Court. Therefore, it is prayed that the applicants be granted anticipatory bail. 3 4. On the other hand, learned State counsel, appearing for the non - applicant/State, opposes the prayer for grant of anticipatory bail. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts & circumstances of the case, submission of learned counsel for the parties, materials available on record, considering the nature of allegation levelled against the applicants and also considering the fact that investigation and trial are likely to take some time, without commenting anything on the merits of the case, I am inclined to grant anticipatory bail to the present applicants. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicants – Mukesh Verma, Smt. Dageshwari Verma & Manishankar Dhruv on each of them executing a personal bond and one surety in the like sum to the satisfaction of the arresting Officer, they shall be released on bail on the following conditions:- (a) The applicants shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) The applicants shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The applicants shall appear before the trial Court on each and every date given to them by the said Court till 4 disposal of the trial. (d) The applicants and the surety shall submit a copy of their adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
