Rakib (Rejected) CRM (NDPS) 1207 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with English Bazar Police Station case no. 1656 of 2025 dated 02.08.2025 under Sections 21(C)/27A/29 of the NDPS Act. And In the matter of : Karim Momin & Anr. ……Petitioners. Mr. Amitabha Karmakar Mr. Arup Kumar Bhowmick .....for the Petitioners. Mr. Moyukh Mukherjee .....for the State. Learned advocate appearing for the petitioners submit that there has been alleged recovery of more than 2.5 kgs of brown sugar and although, the petitioners are in custody for more than 10 months but there is no possibility of the trial commencing in near future. As such, the petitioners may be released on bail. Learned advocate appearing for the State opposes the prayer for bail. I have taken into account the huge quantity of recovery of contraband and is of the opinion that rigors of Section 37 of the NDPS Act is attracted, as such at this stage the prayer for bail of the petitioners is rejected. Learned trial Court, however, is directed to split up the trial of the case by exhausting the process of law, if required, and at the earliest overcome the stage of consideration of charges. 2 Learned trial Court would give priority to the evidence of the seizure list witnesses. Petitioners would after the evidence of the seizure list witnesses are over renew their prayer for bail. At this stage, CRM (NDPS) 1207 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
