Accused No.4 in Crime No.602/2025 registered by Bellanduru Police Station, Bengaluru City, for the offences punishable under Sections 305, 318(4), 340(2), 336(2), 319(2), 336(3), 61(1) of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard learned counsel appearing for the petitioner and learned Addl. SPP appearing for the respondent-State. 3. FIR in Crime No.602/2025 was registered by Bellanduru Police Station, Bengaluru City, for the aforesaid offences against one Venkatesh and others, based on the first information dated 19.12.2025 received from Dr.Shyamal Reddy. Apprehending arrest in the said case, petitioner herein had filed Crl.Misc.No.3559/2026 along with accused No.3, who is his mother-in-law, before the - 3 - HC-KAR NC: 2026:KHC:32535 CRL.P No. 6872 of 2026 jurisdictional Sessions Court, which was rejected on 28.04.2026. Therefore, the petitioner is before this Court. 4. Learned counsel appearing for the petitioner submits that the accused No.3 has been granted anticipatory bail by this Court in Criminal Petition No.7383/2026 on 23.06.2026. Allegation against the petitioner herein, who is the son-in-law of accused No.3, is similar. The petitioner has no other criminal antecedents. Accordingly, he prays for allowing the petition. 5. Per contra, learned Addl. SPP appearing for the respondent-State has opposed the bail petition. However, has not disputed the submission made by the learned counsel appearing for the petitioner. 6. This Court has granted anticipatory bail to accused No.3, who is the mother-in-law of the petitioner herein, in Criminal Petition No.7383/2026 on 23.06.2026. In the said order, it was taken note of the fact that the accused No.3, who is a married lady, aged 48 years, was kidnapped and - 4 - HC-KAR NC: 2026:KHC:32535 CRL.P No. 6872 of 2026 criminally intimidated by the son-in-law of the first informant herein and others and therefore, a police complaint was lodged in Devanahalli Police Station on 27.09.2025. 7. Perusal of the averments found in the said complaint as well as the averments found in the present complaint would to show that there is a civil dispute between the parties. Allegation now made against the accused persons in the present case is about creating fraudulent documents. The petitioner, who is said to be the son-in- law of accused No.3, has no other criminal antecedents and has undertaken to co-operate with the police for the purpose of investigation. 8. Under the circumstances, I am of the opinion that the prayer made by the petitioner for anticipatory bail needs to be answered affirmatively subject to imposing appropriate conditions. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.602/2025 registered by Bellanduru Police Station, Bengaluru City, for the offences punishable under Sections 305, 318(4), 340(2), 336(2), 319(2), 336(3), 61(1) of BNS, 2023, subject to the following conditions: 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witness and he shall co-operate - 6 - HC-KAR NC: 2026:KHC:32535 CRL.P No. 6872 of 2026 with the police for investigation and appear before them whenever called upon. 4.
