This petition has been preferred by petitioners under Article 226 of the Constitution of India seeking following reliefs:- “10.1 That, this Hon'ble Court may kindly be pleased to call the entire record of the case, in the interest of justice. 10.2 That the Hon'ble Court may kindly further be pleased to consider the case of the petitioner and to direct the respondent no.3 to decide both the appeals filed by the petitioners ie. case no. 202508210900001- A/20(3) year 2024-2025 and case no. 2025092109000111-A/20(3) year 2024-25 together, in the interest of justice. 10.3 That, this Hon'ble Court may kindly be pleased to grant any other relief which this Hon'ble Court may deem fit” 3. Learned counsel for the petitioners submits that aforesaid two appeals are pending consideration before respondent No.3-Upper Collector, Bhatapara. Both the appeals are pertaining to same disputed property as well as between the same parties. It is expected that both the appeals ought to have been decided by clubbing the same. In this regard, first application (Annexure-P/6) and second application dated 11.12.2025 have been filed before the Upper Collector, Bhatapara under Section 32 of the Chhattisgarh Land Revenue Code read with Section 151 of the CPC, but the same have not been decided yet. Hence, he prays that this petition may be disposed of directing respondent No.3 to decide aforesaid two applications and limited prayer sought for by the petitioners may be allowed. 4. Learned counsel for the respondent has no objection to the prayer made by learned counsel for the petitioners. 4 5. On due consideration, limited prayer made by learned counsel for the petitioners is allowed. Respondent No.3 -Upper Collector, Bhatapara is directed to decide aforesaid two applications filed by petitioner under Section 32 of the CG Land Revenue Code read with Section 151 of the CPC expeditiously. It is further observed that two appeals are pending between the same parties for the same land. The issue involved in both appeals is interconnected, therefore, both the appeals be considered and decided by the same order. 6. In view of the above, this petition is disposed of directing respondent No.3 -Upper Collector, Bhatapara to decide the applications filed by petitioners under Section 32 of the CG Land Revenue Code read with Section 151 of the CPC expeditiously, preferably within a period of 60 days from today. 7. With aforesaid observations and directions, this writ petition stands disposed of. 8. Pending interlocutory application(s), if any, also stands disposed of. No order as to cost(s).
