Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner demanded extortion from the informant. It is next submitted that the allegation against the petitioner is false. It is then submitted that the case has been registered upon the complaint of the informant being referred to police under Section 156(3) of the Code of Criminal Procedure and earlier, the same informant instituted Barwadda P.S. Case no. 56 of 2025 which was registered on the basis of the complaint case No. 153 of 2025 of the informant being referred to police under Section 156(3) of the Code of Criminal Procedure against the co-accused namely Md. Akhtar Ansari but the petitioner was not named in that FIR but the police submitted Final Report and did not send up the accused persons of that case for trial. It is further submitted that the petitioner has been in custody
since 29.05.2026 as mentioned in para-17 of the instant bail application. It is next submitted that the charge sheet has been submitted against the petitioner but no witness has been examined and the next date fixed for appearance is
05.10.2026. It is next submitted by learned counsel for the petitioner that the petitioner is ready and willing to co- operate with the trial of the case and undertakes not to annoy or disturb the informant or the other witnesses of the case in any manner during trial of the case. It is next submitted that the co-accused with similar allegations has already been admitted on bail by this court vide order dated 08.07.2026 passed in 6289 of 2026 hence, the petitioner may be admitted to bail.
