3
Order:-
The learned Assistant Government Pleader has placed on record the instructions as received and, as seen from the said instructions, the writ petitioners Nos.1 and 2 passed away during the pendency of the writ petition. Insofar as the services of the 4th petitioner are concerned, it is stated that the 4th petitioner joined at the age of 17 years and completed 18 years of age on 13.05.1987, and that he has completed the qualifying service of six (06) years and is eligible for regularization.
2. Similar is the case of the 5th petitioner. He too joined at the age of 17 years and completed 18 years of age on 06.01.1987. The instructions indicate that the 5th petitioner is also eligible for regularization. Insofar as the 3rd petitioner is concerned, he has not completed five (05) years of qualifying service as on 25.11.1993 and therefore is not entitled to regularization.
3. It is submitted that proposals were sent to the CCLA for regularizing the services of the applicants. However, on account of a mismatch in the number of vacancies and the number of candidates, the proposals are now pending with the CCLA for taking necessary action.
4. Recording the same, this writ petition is closed, making it clear to the respondents to pass appropriate orders regularizing the services of the applicants who are found eligible. The respondents shall also consider the case of the 3rd petitioner, subject to the condition that he has been
4
continuously working with the respondents. Considering the submission that the petitioners have been working on a contingent basis and that two of the petitioners have passed away during the pendency of the writ petition, appropriate orders shall be passed by the respondents within a period of three (03) months from the date of receipt of a copy of this order. There shall be no
order as to costs.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
