The memo reads as under:- "The undersigned counsel for the petitioner submits that the writ petition has become infructuous as the Execution Petition No.25384/2017 is dismissed for non prosecution on 10.07.2024. It is submitted that this writ petition may disposed off as infructuous considering the dismissal of the Execution Petition No.25384/2017 by the 57th Additional City Civil and Sessions Judge (CCH-58), Mayo Hall at Bengaluru on 10.07.2024, for non prosecution of the petition by the petitioners. Wherefore it is prayed that the petition may be disposed off as infructuous with a liberty to file the writ petition if the respondents prefers to reopen the dismissal order dated 10.07.2024, in the interest of justice and equity". 3.
