04/07.09.2026 Heard Md. Razaullah Ansari, learned counsel for the appellant and learned A.P.P. for the State. This appeal is directed against the order dated 18.06.2026 passed by the learned Additional Sessions Judge-I, Sahibganj in Bail Petition No. 154/2026 in connection with Barhait P.S. Case No. 55 of 2026, whereby and whereunder, the prayer for regular bail of the appellant has been rejected. It has been alleged that the appellant had enticed away the sister of the informant on the promise of providing a job in Kerala. Submission has been advanced by the learned counsel for the appellant that the victim has returned and her statement has also been recorded by the police. It has been submitted that the appellant is in custody since 24.04.2026 and he does not have any criminal antecedent related to human trafficking. It has further been submitted that the charge sheet has already been submitted by the police. Learned A.P.P. has opposed the prayer for bail of the appellant and has referred to paragraph-3 of the case diary, wherein the statement of the victim has been

recorded, in which she has stated that she was inclined to go outside and that the appellant, on the pretext of providing a job in Kerala, had taken her to Delhi. It appears that charge sheet has been submitted by the police and the statement of the victim has also been recorded. The appellant does not have any criminal antecedent with respect to human trafficking. On consideration of the aforesaid facts and the period of custody undergone by the appellant, we, while setting aside the order dated 18.06.2026 passed by the learned Additional Sessions Judge-I, Sahibganj in Bail Petition No. 154/2026, direct that the appellant be released on bail on furnishing a bail bond of Rs.
10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of the learned S.D.J.M., Sahibganj in connection with Barhait P.S. Case No. 55 of 2026, subject to the condition that appellant shall remain physically present before the learned trial court on each and every date till the conclusion of the trial unless prevented by a sufficient cause.
