Learned counsel for the petitioner would submit that the instant contempt petition has been filed against the defiance of the order dated 09/06/2025 in WPC No.2558 of 2026 passed by this Court wherein it was directed to conclude the due enquiry within 60 days from the date of receipt of copy of the order and thereafter pass a reasoned order within 30 days from the date of completion of enquiry. She would next submit that pursuant to the order passed by this Court, the petitioner submitted ASHUTOSH MISHRA Digitally signed by ASHUTOSH MISHRA Date: 2026.07.09 10:45:52 +0530 2 / 3 the copy of order dated 09/06/2025 on 18/05/2026, however, despite that the respondent authorities have not concluded the enquiry within the stipulated time. 2. I have heard learned counsel for the petitioner and perused the order passed by this Court in WPC No.2558 of 2026. This Court in WPC No.2558 of 2026 on 09/06/2025 has passed the following order:- 11. Considering the fact that the application of the petitioner is still pending before the competent authority, the writ petition is allowed and disposed of with a direction to the respondent no.2 to conclude the due enquiry within 60 days from the date of receipt of copy of this order and after the enquiry is completed, pass a reasoned order at the earliest, preferably within 30 days from the date of completion of enquiry. 3. From perusal of the material available on record, particularly Annexure C/2, it is evident that the petitioner submitted the representation before respondent No.2 on 18.05.2026 in compliance with the directions issued by this Court on 9.6.2025. The order passed in the writ petition granted a period of sixty days to the competent authority to conclude the enquiry from the date of receipt of the copy of the order and thereafter to pass a reasoned order, preferably within thirty days. The present contempt petition has admittedly been filed on 02.07.2026, i.e., before expiry of the period of sixty days granted by this Court for completion of the enquiry. Thus, the respondents were still within the time permitted by the 3 / 3 Court to comply with the directions contained in the writ order. In the absence of expiry of the stipulated period, no wilfull or deliberate disobedience of the order of this Court can be attributed to the respondents. 4. Since the cause of action for initiating contempt proceedings had not accrued on the date of filing of the present petition, the contempt petition is premature and not maintainable. Accordingly, the same deserves to be dismissed, leaving it open to the petitioner to avail such remedy as may be available in law in the event of non-compliance after expiry of the time granted by this Court. 5.
