By way of this writ petition under Article 226 of the Constitution of India, the petitioner has questioned the impugned order dated 04/09/2019 (Annexure P/5) passed by the Tahsildar and Manager, Rajgami Sampada Trust, Rajnandgaon whereby application filed by respondent No. 6 for allotment of the plot/shop in the name of her major son namely Saurabh Jha has been rejected. 3. During the pendency of this writ petition, the son of respondent No. 6 namely Saurabh Jha has also died on 26/12/2022. 3 4. In that view of the matter, I am of the considered opinion that since the property in question was recorded in the name of Late Girish Jha, therefore, it be allotted to his wife Smt. Meena Jha i.e. respondent No. 6 and the petitioner has no locus to seek allotment of the said property in her name. 5. Accordingly, this writ petition stands disposed of reserving liberty in favour of respondent No. 6 to move appropriate representation for allotment of the property in question in her name before respondents No. 3 and 4 within one month from the date of receipt of a copy of this order, which will be considered and decided by them absolutely in accordance with law within two months from the date of filing of the representation.
