This is the second bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 32/2026 registered at Police Station - Dongargaon, District – Rajnandgaon (C.G.) for the offences punishable under Sections 296, 351(2), 109, 3(5), 191 of Bharatiya Nyaya Sanhita, 2023 and Section 25 of Arms Act. 2. Earlier first bail application was rejected by this Court on merits vide order dated 19.03.2026 passed in MCRC No. 2589/2026. 3. The prosecution case, in brief, is that on 26.01.2026, at about 4:00 PM, the injured, Gaindram Sonkar, had gone to Rudgaon village to attend a PREETI KUMARI Digitally signed by PREETI KUMARI Date: 2026.07.09 20:26:29 +0530 2 fair along with his friend, Abhay. After roaming around the fair, while they were eating, the injured allegedly used abusive language. At that time, the accused persons, who were passing by while smoking cigarettes, questioned him as to why he was using abusive language. Thereafter, a verbal altercation ensued, during which the accused persons allegedly abused the injured and assaulted him with fists, kicks, and a knife, causing injuries to his chest, head, forehead, and right hand. The incident was reported to the injured's father, who lodged a complaint at Police Station Dongargaon. On the basis of the said complaint, Crime No. 32/2026 was registered against the accused persons for offences punishable under Sections 296, 351(2), 109, 3(5), and 191 of the Bharatiya Nyaya Sanhita, 2023, along with Section 25 of the Arms Act. After completion of the investigation, the charge-sheet has been filed. 4. It has been argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. It is further submitted that this is the second bail application of the applicant. He further submits that the applicant has been in jail since 22.02.2026. So far as the status of the trial is concerned, out of 25 prosecution witnesses, only 04 witnesses has been examined including the victim and has turned hostile. He also submits that the applicant has no previous criminal antecedents. Therefore, he prays for grant of regular bail to the applicant. 5. On the other hand, learned counsel appearing for the State/non-applicant opposes the bail application and submits that the charge-sheet has already been filed. He further submits that the first bail application was rejected by this Court on merits vide order dated 19.03.2026 passed in MCRC No. 2589/2026, therefore he is not entitled for grant of bail. 3 6. I have heard learned counsel appearing for the parties and perused the case diary. 7. Considering the facts and circumstances of the case, the nature and gravity of the allegations levelled against the applicant, and the fact that this is the second bail application filed by the applicant, whereas the first bail application was dismissed on merits by this Court vide order dated 19.03.2026 passed in MCRC No. 2589/2026, the only new ground urged is that, out of 25 prosecution witnesses, four witnesses, including the victim, have been examined and have turned hostile. However, considering the apprehension that, if released on bail, the applicant may influence the remaining prosecution witnesses or otherwise hamper the trial, this Court is not inclined to extend the benefit of regular bail to the applicant. 8. Accordingly, the second bail application of the applicant - Vijay Kumar Gond filed under Section 483 of the BNSS for grant of regular bail to the applicant who has been arrested in connection with Crime No. 32/2026 registered at Police Station - Dongargaon, District – Rajnandgaon (C.G.) for the offences punishable under Sections 296, 351(2), 109, 3(5), 191 of Bharatiya Nyaya Sanhita, 2023 and Section 25 of Arms Act, is rejected. 9.
