1. This is the second bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail
2 to the applicants who have been arrested in connection with Crime No. 09/2026 registered at Police Station Arakshi Kendra Basantpur Distt- Balrampur- Ramanujganj (C.G.) for the offence punishable under Sections 70(1), 3(5) of the BNS. 2. Case of the prosecution, in brief, is that Crime No. 09/2026 registered at Police Outpost Wadrafnagar, Police Station Basantpur, reveals that on 18.01.2026, at about 6:00 A.M., the applicant/accused allegedly telephoned the victim and induced her to come to Wadrafnagar on the pretext of providing her with employment. Upon her arrival, the applicant took her to a room where he called two of his associates, who brought liquor. Thereafter, the applicant and his associates consumed liquor and also allegedly made the victim consume liquor. It is further alleged that thereafter all three accused persons committed gang rape upon the victim one after another. On the basis of the said report, an FIR was registered against the accused persons, and the matter was taken up for investigation. Hence, the bail application. 3.
Learned counsel for the applicants submits that the first bail application was rejected by this Court on merits vide order dated 24.04.2026, therefore this second bail application is filed on the ground that the statement of victim has already been recorded before the trial Court, wherein she has categorically stated that she lodged the FIR against the present applicant on account of a dispute between them regarding payment of wages, so far as the
3 status of trial is concerned, out of 14 witnesses, the statement of only 3 witnesses have been recorded till date and the applicants are in jail since 20.01.2026, hence the conclusion of trial is likely to take some time, therefore, he prays for releasing the applicants on regular bail. 4. On the other hand, learned State Counsel opposes the bail application and submits that there are specific and serious allegations against the present applicants. It is contended that, in furtherance of their common intention, the applicants lured the victim to Wadrafnagar on the false pretext of providing her employment. Thereafter, they allegedly made her consume liquor and committed gang rape upon her one after another. On the basis of the report lodged by the victim, the aforesaid FIR was registered, and the applicants were arrested during the course of investigation. In view of the nature and gravity of the allegations, learned State Counsel prays for rejection of the bail application. 5. I have heard learned counsel for the parties and perused the case diary. 6. From perusal of the records, it transpires that this is the second bail application of the applicants and first bail application of the applicants was rejected by this Court vide common order dated 24.04.2026 in MCRC No. 2522 of 2026 on the ground that the involvement of the applicant was found in alleged commission of gang rape after luring the victim on the false pretext of providing
4 employment and making her consume liquor.
The material collected during investigation and available in the case diary prima facie discloses the involvement of the applicants in the commission of the offence. Furthermore, the victim in her statement recorded under Section 183 of BNSS, supported the case of prosecution, but the consequent statement recorded before the trial Court goes to show that the applicant has entered into tempering with the evidence, there appears to be no good ground to entertain the present second bail application of the applicant. 7. Accordingly, the second bail application of the applicants- Ravichand Parsiya and Tejmani, involved in Crime No. 09/2026 registered at Police Station Arakshi Kendra Basantpur Distt- Balrampur- Ramanujganj (C.G.) for the offence punishable under Sections 70(1), 3(5) of the BNS, is rejected at this stage. 8. Needless to say that the trial Court concerned is at liberty to proceed and concluded the trial expeditiously. 9. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information and compliance. Sd/- Sd/-
