In this writ petition, the petitioner is assailing the order dated 07.01.2025 passed in Appeal No. 277 of 2024 on I.A. No. 2 by the Karnataka Appellate Tribunal, Bengaluru (Annexure-J), whereby the application filed by the petitioner came to be dismissed. 3. Heard the learned counsel appearing for the parties. 4. Having heard the learned counsel appearing for the petitioner and the learned Additional Government Advocate, it is noticed that the petitioner had filed I.A. No. 2, seeking exemption from depositing 25% of the award amount as required under Section 105(2) of the Karnataka Co-operative Societies Act, 1959 (for short, the Act). - 4 - HC-KAR NC: 2026:KHC:18749 WP No. 10878 of 2026 5. Taking into consideration the findings recorded by the Karnataka Appellate Tribunal at paragraphs 9 and 10 of the impugned order (Annexure-J), and having regard to the scope and ambit of Section 105(2) of the Act, which mandates that an aggrieved party challenging an award for payment of money shall deposit 25% of the award amount, I am of the view that no interference is called for in this writ petition. Accordingly, the writ petition is dismissed. 6. However, it is open for the petitioner to deposit 25% of the award amount, as required under Section 105(2) of the Act, before the Karnataka Appellate Tribunal within an outer limit of three months from the date of receipt of a certified copy of this order.
