The prosecution case, in brief, is that the accused and the de facto complainant were colleagues in the R & B Department. The complainant, a divorced woman since January 2023, joined the Vijayawada office, and upon learning of her marital status, the accused developed a friendship with her, professed his love, falsely claimed that he was divorced from his first wife, and promised to marry her. Believing his representations, the complainant entered into a physical relationship with him. When she later insisted on marriage, the accused allegedly postponed the matter on one pretext or another. Subsequently, upon making inquiries, the complainant discovered that the 4 accused was already married and had a daughter. Therefore, she gave report to the police against the accused. Basing the said report, a case in Crime No. 130 of 2025, dated 29-07-2025, on the file of Krishnalanka Police station, was registered. 4. Learned counsel for the petitioner would submit that the petitioner herein and also the defacto complainant both are working as Engineers in R & B Department. Learned counsel would further submit that this Court has granted interim protection to the petitioner. Consequent to which, the police have issued notice under Section 35(3) of BNSS in this matter. Learned counsel for the petitioner would further submit that as per the content of the complaint, the offence alleged to have been taken place prior to BNS. Hence, the very application of Section 69 of BNS, to the present set of facts itself is doubtful. Learned counsel for the petitioner would further submit that the petition may be disposed of continuing the protection which was granted to the petitioner vide Order dated 03.11.2025. 5. Learned Assistant Public Prosecutor would submit that the petition may be disposed of giving liberty to the Investigating Officer to proceed with the investigation and come up with the report. 6. Learned counsel for the respondent No.2 would submit that the petition may be disposed of by imposing stringent conditions against the petitioner. 7. Considering the submissions made, this Criminal Petition is disposed of with the following: 5 a. A notice has already been issued by the police under Section 35(3) of BNSS to the petitioner in this matter. b. Investigating Officer is at liberty to proceed with the investigation and file a report according to law as expeditiously as possible. c.
