JUSTICE CHILLAKUR SUMALATHA ORAL ORDER Heard Sri.Abhilesh.J learned counsel for the petitioner as well as Sri.K.N.Arvinda Navada who represents Sri.Sudhakar V learned counsel on record for the respondent. 2. Seeking the Court to issue a Writ of Certiorari and to set aside the order passed by the Court of Principal Judge, Family Court, Bangalore on I.A No.II in M.C.No.5715/2021 clubbed with M.C.No.6077/2021 dated 23.08.2025, this writ petition is filed. - 3 - HC-KAR NC: 2026:KHC:29215 WP No. 7807 of 2026 3. Through the impugned order, Family Court directed petitioner herein to pay respondent a sum of Rs.40,000/- per month towards interim maintenance of the respondent as well as the child and aggrieved by the same, this writ petition came to be filed. 4. Learned counsel for the petitioner submits that I.A No.II was filed in the year 2021. As many as 21 adjournments were taken by the respondent/wife to submit her contentions on I.A. No.II. On 11.08.2025 wife i.e., the respondent herein submitted her written arguments. On that day the counsel representing the husband i.e., the petitioner herein due to personal reasons could not represent the matter. The Court without giving any opportunity to the petitioner/husband to make his submissions, posted I.A No.II for orders and pronounced orders on 23.08.2025 directing petitioner herein to pay respondent/wife huge sum of Rs.40,000/- towards interim maintenance, to clear all arrears which comes to Rs.10,00,000/- within 2 months and also to pay a sum of - 4 - HC-KAR NC: 2026:KHC:29215 WP No. 7807 of 2026 Rs.25,000/- towards litigation expenses. Learned counsel submits that even respondent/wife is working and thus there is no necessity for her to claim maintenance from the petitioner/husband. Petitioner is always willing to maintain the child and to meet 50% of the educational expenses. As no opportunity was accorded to the petitioner to submit his contentions on the merits of the matter and as huge sum was awarded towards interim maintenance, this writ petition is filed. Learned counsel thereby seeks to quash the impugned order. 5. On the other hand, learned counsel for respondent submits that the child aged around 6 years is under the custody of respondent and respondent requires huge sum for the maintenance of the child. 6. At para 10 of the impugned order there is a mention that respondent/wife filed her affidavit of assets and liabilities wherein she mentioned that she has done MBA, that her monthly general expenses is Rs.85,000/- - 5 - HC-KAR NC: 2026:KHC:29215 WP No. 7807 of 2026 that she is working in 24/7 private company and is earning Rs.31,000/- per month. Both the cases were filed in the year 2021 and are pending still. Therefore, this Court is of the view that in case matters are disposed of by the Family Court expeditiously, parties to the proceedings will get benefited. Thus, instead of remanding the matter back to the Family Court to decide I.A.No.II, it will be better to make some interim arrangement so that the main cases will get disposed of. Therefore, this writ petition is disposed of with the following: ORDER (i) The order that is rendered by the Court of Principal Judge, Family Court, Bengaluru on I.A.No.II in M.C.No.5715/2021 clubbed with M.C.No.6077/2021 is modified. (ii) Petitioner/husband is directed to pay respondent/wife a sum of Rs.25,000/- per month towards interim maintenance of respondent/wife as well as child till the disposal of the pending cases i.e., MC.No.5715/2021 clubbed with MC.No.6077/2021. - 6 - HC-KAR NC: 2026:KHC:29215 WP No. 7807 of 2026 (iii) Such payment shall be made from the date of filing of I.A.No.II i.e., from 06.11.2021. (iv) All arrears at the rate mentioned above shall be cleared within eight weeks. (v) Family Court is directed to make all endeavour to dispose of M.C.No.5715/2021 clubbed with M.C.No.6077/2021 within a period of three months from the date of receipt of copy of this order.
