HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT SRINAGAR
CCP(S) No.259/2026 In WP(C) No.1649/2025
BANERAJI KUMAR KAW
…Petitioner
Through: Mr. Parvaiz Nazir, Advocate.
VERSUS
RAJIV OMPRAKASH PANDEY AND OTHERS
…Respondent(s)
Through: None.
CORAM:HON’BLE MR. JUSTICE RAHUL BHARTI, JUDGE.
ORDER 04.08.2026
1. The petitioner had self-invited disposal of his writ petition WP(C) No.1649/2025 without inviting this court for adjudication on merits but feeling contended with a direction unto the writ respondents to consider the writ petition as a representation for consideration within a period of six weeks from date of service of copy of the disposal order dated 18.07.2025 the petitioner has taken more than one year to come to realization that the needful exercise intended by this Court in terms of its
order dated 18.07.2025 has not been carried out. Sr. No. 135 Supp. Cause List-I
2. More than the contemnors, this Court reckons that it is the petitioner who has acted in breach of the court
order dated 18.07.2025 which renders him disentitled to earn any indulgence in response to the present contempt petition. This petition is not entertained without prejudice to any other remedy available at the disposal of the petitioner to pursue in accordance with law.
3. In addition, reason for this Court to accord dismissal to this contempt petition at its very inception stage is the failure on the part of the petitioner to come up with a bare proof of fact as to when did he serve the copy of the
order dated 18.07.2025 unto the writ respondents.
4. Dismissed as such.
