By this petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner, namely, Amir Uddin, has prayed for granting pre- arrest bail, apprehending arrest in connection with Kaki P.S. Case No. 38/2025 under Section 310(4)/140(3)/126(2)/61(2) /3(5) of BNS, 2023. 3. The case arose out of an FIR dated 26.07.2025 lodged by one Khairul Islam Borbhuyan with the allegation that on 23.07.2025 in the evening, he and his friend Amzad Hussain Laskar were coming from Cachar towards Guwahati in his struck bearing Regd No. AS-25-FC-7194 (Ashok Leyland) loaded with Areca nuts. It is further alleged that on the way, one Alto car bearing Regd No. AS-12- D-4354 and Tata Yodha vehicle bearing Regd. No. AS-31-C-1553, wrongfully restrained them and tried to commit dacoity, but when they were taken to rice mill, the owner of the rice mill saved them. 4. The petitioner’s side drawing attention to para 4 of the bail petition, submits that Samim Borbhuiyan and Mamon had hired his vehicle for Rs.3,500/- and later, he came to know about the incident. The said vehicle was seized on 24.09.2025. 5. The petitioner was granted interim bail on 05.12.2025. It is submitted by the learned Addl. P.P. that in the meantime, upon completion of investigation, charge-sheet has been submitted vide charge-sheet No.06/2026, dated 31.01.2026. 6. In the given facts and circumstances, including completion of investigation, the interim bail order dated 05.12.2026 is hereby made absolute, subject to the following conditions that:- (i) The petitioner shall be available for the trial, if one commences. Page No.# 3/3 (ii) He shall not hamper or tamper with the evidence. (iii) He shall not misuse his liberty to commit any illegal activities or offences. 7. Violation of any bail condition will entail cancellation of the bail. 8. Accordingly, this instant anticipatory bail application stands allowed and disposed of. 9. Send back the case diary.
