JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.8 in Crime No.57/2026 registered by Konanakunte Police Station, Bengaluru City for the offences punishable under Section 316(1), 318(2), 336(3) and 61(2) of BNS, 2023 is before this Court, in this petition filed under Section 482 of BNSS is seeking anticipatory bail. 2. Heard the learned counsel for the petitioner and learned HCGP on behalf of respondent No.1 / State. 3. FIR in Crime No.57/2026 was registered by Konanakunte Police Station, Bengaluru City for the aforesaid offences, based on the first information dated 21.02.2026 received from Kumaresh D.S., who is the authorized representative of the Finance Company known

Apprehending arrest in the said case, the petitioner had filed Crl.Misc.No.2253/2026, which was rejected by the jurisdictional Sessions Court on 27.03.2026. Therefore, he is before the Court. 4. Learned counsel for the petitioner submits that with similar allegations, another complaint was filed by the very same first informant before the very same police station in Crime No.56/2026 and in the said case the petitioner has been granted anticipatory bail by this Court in Crl.P.No.6226/2026 disposed of on 01.06.2026. The petitioner is the Manager of the Bank and the loan was sanctioned based on the legal opinion and valuation report issued. The petitioner is ready and willing to co-operate with the police for investigation. Accordingly, he prays to allow the petition. - 4 -

5. Per contra, learned HCGP who has opposed the petition does not dispute the submission made by learned counsel for the petitioner. 6. The allegation in the first information is that the petitioner, who was the Manager of the complainant Bank had sanctioned loan to the tune of Rs.49,50,000/- for the purpose of purchasing certain properties, based on the fraudulent documents which were submitted by the borrowers. In the first information itself, it is mentioned that the documents which were submitted to the Bank were forwarded to the empanelled legal advisors of the Bank and also to the empanelled valuer. It is only after receiving the opinion/report from them, the aforesaid loan was sanctioned. 7.
Considering the aforesaid aspects of the matter, the petitioner has been granted anticipatory bail in Crime No.56/2026 registered by the very same police station, in Crl.P.No.6226/2026. Petitioner has undertaken to co-

HC-KAR NC: 2026:KHC:32507 CRL.P No. 6297 of 2026 operate with the police for the purpose of investigation. Under these circumstances, the prayer made by the petitioner for grant of anticipatory bail needs to be granted, subject to appropriate conditions. Accordingly, following:
O R D E R i. The criminal petition is allowed. The respondent - Police or any other police in the State of Karnataka are
directed to release the petitioner in the event of his arrest in Crime No.57/2026 registered by Konanakunte Police Station, Bengaluru City for the offences punishable under Section 316 (1), 318 (2), 336 (3) and 61 (2) of BNS, 2023, subject to the following conditions:
1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer.

2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons.
3. Petitioner shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon.
