By filing this writ petition, the petitioner has prayed for the following reliefs:-
“(i) For direction commanding the respondent No.2 and 3 to consider and dispose of the petitioner’s complain dated 30/07/2026 in accordance with law. (ii) For directing the respondent No.2 and 3 to conduct a spot inspection of the

construction raised by the Respondent No.6 to 9 and compare the same with the sanctioned building plan. (iii) For directing the respondents to determine whether the construction is authorized and sanctioned building plan. (iv) For, during the pendency of this writ petition restrain the Respondent No.6 to 9 from any construction over the terrace/common area in question and protect the same in accordance with the building plan.”

Heard learned counsel representing the petitioner and
learned counsel representing the respondents.

It is the grievance of the petitioner who claims himself to be the land owner, that the developer is making unauthorized construction, which is beyond the sanctioned plan. It is his case that the Dhanbad Municipal Corporation is not taking any step to stop the unauthorized construction.

Learned counsel representing the respondent – Dhanbad Municipal Corporation, Dhanbad, submits that they will look into the grievance of the petitioner and will take appropriate steps, if the petitioner files a detailed representation along with supporting documents.

Considering the said submission, I direct the petitioner to approach the respondent – Dhanbad Municipal Corporation, Dhanbad, by filing a fresh representation with all documents, within four weeks.
5.1. Upon receipt of such representation, the respondent – Dhanbad Municipal Corporation, will consider the case of the

petitioner and pass an appropriate order, within eight weeks thereafter; and also communicate the order to the petitioner.

With the aforesaid directions, this writ petition stands
disposed of.
