Accused in Crime No.92 of 2026 registered by Kaggalipura Police Station, Bengaluru South for offence punishable under Section 137(2) and 87 of BNS, 2023 is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.92 of 2026 was registered by Kaggalipura Police Station, Bengaluru South, against unknown persons initially for offence punishable under Section 137(2) of BNS, 2023, based on the first information dated 27.03.2026, received from the mother of alleged victim girl. In the said case, petitioner was arrested on 28.03.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.690 of 2026 was rejected on 04.05.2026. Therefore, he is before this Court. 4. Perusal of the material on record would go to show that, the alleged minor victim girl was found missing from her house on 25.03.2026. Efforts made to trace her had failed. On - 3 - HC-KAR NC: 2026:KHC:33027 CRL.P No. 7128 of 2026 27.03.2026, her mother had approached the police and submitted the first information, based on which, FIR was registered in Crime No.92 of 2026 against unknown person initially for offence punishable under Section 137(2) of BNS, 2023. During the course of investigation, the petitioner and the victim were traced. The petitioner was arrested on 28.03.2026 and remanded to judicial custody. The statement of the victim girl appears to have been recorded immediately thereafter and the contents of the same are extracted in the remand application of the petitioner, which is made available to this Court. A reading of the same would go to show that, the victim had voluntarily gone along with the petitioner on 25.03.2026. 5. Petitioner aged 27 years having no other criminal antecedent is in custody from 28.03.2026. Investigation of the case is completed and charge sheet is already filed. Under the circumstances, I am of the opinion that, the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. 6. The petitioner is directed to be enlarged on bail in Crime No.92 of 2026 registered by Kaggalipura Police Station, Bengaluru South for offences punishable under Sections 137(2) and 87 of BNS, 2023, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. - 5 - HC-KAR NC: 2026:KHC:33027 CRL.P No. 7128 of 2026 e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
