For the State : A.P.P. --------- 02/30.03.2026 Heard Mr. B.M. Tripathi, learned Senior Counsel for the petitioners and learned A.P.P. for the State. The petitioners are accused in connection with Kolebira P.S. Case No. 89/2025. The husband of the informant was dragged by some persons and brutally assaulted which resulted in his death during treatment. It has been submitted by Mr. B.M. Tripathi, learned Senior Counsel for the petitioners that the assault was committed by the petitioners with legs, fists and stick. It has been submitted that a quarrel had taken place on account of an allegation made against the deceased that he was stealing the pump which finds reflection at paras 15, 28, 29, 41 and 42 of the case dairy. Learned counsel adds that the petitioners are in custody since 28.11.2025. Learned A.P.P. has opposed the prayer for bail of the petitioners and has submitted that the petitioner no. 1 has got four criminal antecedents. Regard being had to the manner of assault committed by the petitioners and the fact that the incident had taken place on account of a dispute with respect to the allegation of the deceased stealing a motor pump which has been stated by several of the witnesses, the petitioners, named above, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) each with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Simdega in connection with Kolebira P.S.
